John Ingrassia’s client was charged with Driving While Intoxicated and numerous other traffic infractions including passing a red light , making an unsafe lane change, refusing to provide a preliminary breath test and failing to signal within 100 feet of turning.
After a lengthy trial the client was found not guilty of all charges except for failing to signal within 100 feet of turning.
During cross examination Mr. Ingrassia was able to confront two New York State Troopers with major inconsistencies between what their trial testimony was and what their testimony was from a prior pre trial hearing in the case. By exposing that the police officers stories had changed as to where his client committed the alleged red light violation, their credibility regarding other important aspects of their testimony was so significantly damaged that the prosecution could not overcome the damage that had been brought out on cross examination. As a result, the defendant was found not guilty of DWI and of all other charges except for the turn signal violation.
