The firm successfully defended our client that was charged with Driving While Intoxicated and Refusal to Submit to a Chemical Test. We defended our client’s alleged Refusal to Submit to a Chemical Test before a Department of Motor Vehicle Administrative Law Judge (ALJ).
Our firm, through cross examination, showed that the arresting officer failed to adequately advise our client of his refusal warnings. In addition, we exposed the officer of not granting our client an opportunity to speak with an attorney, after he requested to do so. As a result, the ALJ dismissed the Refusal.
