His client was parked in a parking lot with the motor vehicle running when police came upon the vehicle late at night.
Mr. Ingrassia persuaded prosecutors that although the vehicle and traffic law defines vehicle operation as sitting behind wheel with the motor running, developing case law requires an intent on the person’s part to place the vehicle in operation. He then successfully argued that there was insufficient evidence to establish that prior to arriving to that location that his client was impaired by a drug.
