John Ingrassia successfully had a client’s conviction for sex abuse second-degree reversed on appeal by the New York State Supreme Court Appellate Term for the 9th and 10th judicial districts.
The accused was convicted after a jury trial where he was represented by a different attorney.
Mr. Ingrassia successfully argued to the appellate court that his client was denied a fair trial due to the improper questioning by the prosecutor of his client during the cross examination of his trial testimony, As well as by improper comments made by the prosecution during summation which impermissibly shifted at the burden of proof from the prosecution to the defense.
Under the law an accused in a criminal trial does not bear the burden of proof to prove that they are not guilty.
Mr. Ingrassia also successfully argued that his client was denied his constitutional right to effective assistance of counsel due to the representation that his client received during the trial which also denied him a fair trial .
His client had been sentenced to 30 days in jail, probation and was required to register as a sex offender under the New York State sex offender registration act. As a result of the reversal, his sentence was vacated and a new trial was ordered.
This case is an illustration of the importance of seeking out an opinion from experienced appellate counsel if you or someone you know has been convicted of a crime and wishes to file an appeal.
In addition to being a very experienced trial attorney, Mr. Ingrassia also has decades of experience in handling appeals and has successfully written and argued appeals at every level of appellate court in New York State.
