John Ingrassia recently obtained a verdict of guilty for Driving While Ability Impaired by Alcohol in a local Justice Court in Orange County.
His client was originally charged with of Driving While Intoxicated and Driving with a Blood Alcohol content (BAC) of .08 or more.
Mr. Ingrassia’s client was involved in a motor vehicle accident and as a result his blood alcohol level content was a .13 percent.
Mr. Ingrassia’s cross examination of the prosecution’s toxicologist established flaws in the collection of his client’s blood and in the testing procedures that called into question the reliability of the blood test result.
As a result, the verdict was for the non-criminal violation of Driving While Ability Impaired By Alcohol
