In July of 2013, the Firm was successful in obtaining an Order from the Family Court directing the County to produce the 911 tapes during an alleged incident on behalf of a client named in an abuse and neglect petition. The County filed a motion to seal the tapes as related to the County Law Section 308(4) which prohibits disclosure of 911 calls. We argued on behalf of the client that the tapes were material and necessary to the judicial proceeding at hand and that all the parties were entitled to the tapes. The Court denied the County’s motion and permitted the disclosure of the 911 tape to the parties, citing the importance of the parties’ ability to access potentially relevant and material evidence.
