January, 2011 – Larkin Ingrassia, PLLC won an appeal in the Appellate Division, Second Department and was able to have a Qualified Domestic Relations Order vacated where the Order granted a spouse survivorship benefits with respect to the other spouse’s pension benefits. The parties entered into a stipulation in settlement that provided for a sharing of certain pension benefits. After the Judgment of Divorce was issued, the wife submitted a Qualified Domestic Relations Order that contained additional benefits, not agreed to by the parties. The Newburgh, NY law firm filed an appeal to the Appellate Division, Second Department and had the Qualified Domestic Relations Order vacated on behalf of the husband.
